Pro Bono Going Public 2011: Free Legal Advice Clinics in Vancouver, Victoria and Kelowna

This September, Access Pro Bono is hosting Pro Bono Going Public 2011, an advice-a-thon in which volunteer lawyers offer free legal advice to low and modest-income individuals in Vancouver, Victoria and Kelowna.  The event is also a fundraiser for pro bono services in B.C.; the volunteer lawyers are raising money from friends and family in the same was as runners do in charity races.

Avoid Court Costs with Free (and Low Cost) Online Mediation

On, David Bilinsky writes about two new mediation pilot projects in British Columbia; one for family law matters and one for civil matters where the contested amount is relatively low.

What makes these projects unique is that they will use internet technology, including web-cams to conduct the mediations online.  This will make it easier for parties who are separated geographically to achieve an inexpensive and timely resolution to their legal problems, since online mediations avoid travel costs and scheduling delays.  Because the programs are in their pilot phase, family law parties will be charged on a sliding scale based on income, while civil law parties can participate for free.

Harper's Flank Attack on the Charter

Twenty-nine years ago, on April 17th, 1982, the Charter of Rights and Freedoms was entrenched as part of Canada’s constitution.  Though not yet thirty, my research suggests the Charter’s glory days may already be gone.  The number of Charter equality cases heard by Canada’s highest courts has been steadily declining over the last decade, with the Supreme Court of Canada and Federal Court of Appeal hearing twenty-four equality cases in 1999, and only eleven in 2009. 

While this decline has several causes, including deep funding cuts to legal aid, the endangered equality case is also a victim of the Harper government’s ongoing flank attack against the Charter.  This assault is aimed not at the Charter’s provisions, which remain both extremely popular and extremely difficult to amend, but rather it targets Canadians’ ability to enforce their Charter rights.

The broad rights protections contained in the Charter must be distinguished from the narrow remedy available to enforce them; a protracted and expensive lawsuit against the behemoth resources of a federal or provincial government.
The bridge between Charter rights and Charter remedies consists of money, expertise and time, each in large quantities.  Taking a Charter case through the labyrinthine judicial system to the Supreme Court of Canada takes years and can cost millions of dollars in lawyers’ bills, expert evidence and court fees.  To say that Charter rights are inaccessible for the average Canadian, who earns about $38,400 annually, is an extraordinary understatement.
Thankfully, groups representing vulnerable Canadians provide a bridge between Charter rights and remedies by fundraising, recruiting legal help and preparing test cases to challenge unconstitutional government action.  These groups assemble resources from private entities, but they also rely on modest government funding.
What do we get in return for our small public investment?  Significant savings in time and money, as well as an excellent safeguard of our constitutional democracy.  Public interest litigation is economical because it aggregates and settles the claims of many individuals through a single court case, saving millions of dollars and thousands of hours for both individuals and governments.
More importantly, Charter litigation audits our government’s compliance with its constitutional obligations, in much the same way as the Auditor General audits the government’s compliance with its financial obligations.  Without the prospect of constitutional challenges, there is little to deter governments from violating individual rights.
Plank by plank, the Harper government has quietly deconstructed the bridge between Charter rights and remedies over the past five years.  The biggest of these planks was the Court Challenges Program, which funded landmark challenges to federal government equality and language rights violations.  In September 2006, shortly after Ian Brodie, an outspoken critic of Charter rights and the CCP, became Harper’s Chief of Staff, the CCP was cancelled on the grounds of “wastefulness” and “administrative inefficiency”.  This despite three parliamentary committee reports attesting to the CCP’s efficiency and effectiveness (two reports are available online here and here).
The budgetary rationale for the CCP’s cancellation is also suspect given that its paltry $2.75 million budget was roughly equal to the interest accumulated in one day on the proposed $35 billion fighter jet program.  More likely, Harper wanted to dismantle the CCP’s conduit to Charter rights enforcement. As Harper said in a leaked videotaped speech to Conservative party faithful, “[i]nstead of subsidizing court challenges…by left-wing fringe groups, we have been bringing in laws to crack down on criminals”.

The CCP is not the only victim of Harper’s flank attack on the Charter.  In 2006, the Department on the Status of Women, historically a significant funding source for women’s equality groups, saw twelve of its sixteen offices shut down, and its mandate changed to exclude the pursuit of “equality” and the funding of advocacy activities.  In recent years, the Harper government has systematically defunded dozens of public interest groups which participated in Charter litigation, including the Native Women’s Association of Canada, Rights & Democracy and the National Association of Women and the Law.

Ultimately, a government which upholds the Charter rights of its citizens has nothing to fear from an occasional audit of its constitutional compliance.  Conversely, one which furiously attacks the means by which its citizens can enforce their human rights raises serious doubts about its commitment to the constitution.

In a call to arms against public interest litigation, Mr. Brodie once wrote, “The Charter is simply a document, and documents are not self-enforcing.  Without groups ready to litigate, the Charter can have little impact.”  The decline in equality cases in the wake of Harper’s dismantling of access to Charter remedies suggests that Mr. Brodie is right.  With few left standing to enforce Charter rights, there will be little to celebrate on April 17th.

B.C. Law Week: Free telephone advice from lawyers and more

The B.C. Branch of the Canadian Bar Association is organizing its annual Law Week, which features a number of events from April 6 until April 27 (more than a week, but who's complaining?).  The events are made possible through the volunteer work of hundreds of lawyers from across British Columbia.

Some of the events on the agenda this year include mock trials, a public speaking contest for students, citizenship ceremonies, courthouse tours and a fun run and free public forum in Vancouver.  

The most popular program is undoubtedly the Dial-A-Lawyer event, scheduled for April 16, 2011 from 10:00am to 2:00pm.  Those in need of legal assistance can get 15 minutes of free advice over the phone from volunteer lawyers by calling 1.800.663.1919 or 604.687.3221.

Why There's No Such Thing As an "Anonymous" Internet Comment

It is accepted wisdom that the internet, like alcohol, lowers inhibitions.  Anonymity allows us to instantly, and irrevocably, comment on anything and anybody we come across online, and forums like Twitter seem to encourage off-the-cuff commentary crammed into 140 characters.

In older times, the onerous effort of publication would require second and third pairs of eyes to pass over the printed word, incorporating plenty of time for sober second thought.  Nowadays, one press of the return key sends our words around the world, with no way to predict their reach or consequences.

For those who rely on anonymity to protect them from the costs of indulging in online defamation, a headache worse than any hangover is in the works, courtesy of the Canadian legal system.  In the last two years,  lower courts in two provinces have issued rulings unmasking anonymous posters so they may be sued for libel.  The courts have accomplished this task in two ways; by issuing Norwich orders and applying civil rules of court.

Norwich Orders
A Norwich Order allows someone who claims to have suffered a legal wrong to obtain a court order requiring a third party to disclose identifying information about the perpetrator of the alleged wrong.  In the case of anonymous posters on blogs, forums and other websites, the victim of the alleged defamation can obtain a Norwich Order requiring the internet service provider (ISP) or the website authors or administrators to provide personal information about anonymous commenters, including their names, email addresses, ISP addresses, etc.

In order to get a Norwich Order, the applicant must satisfy a five-part test:
  • whether the applicant has provided evidence sufficient to raise a valid, bona fide or reasonable claim;
  •  whether the applicant has established a relationship with the third party from whom the information is sought, such that it establishes that the third party is somehow involved in the acts complained of;
  • whether the third party is the only practicable source of the information available;
  • whether the third party can be indemnified for costs to which the third party may be exposed because of the disclosure; and
  • whether the interests of justice favour obtaining the disclosure.
In a 2009 Ontario Superior Court of Justice decision, York University v. Bell Canada Enterprises, the court issued a Norwich order to require Bell Canada, an ISP, to provide contact information for customers who anonymously posted allegedly defamatory comments about York University academic staff.

Rules of Court
In some cases, provincial rules of court permit pre-action discovery which allows the party launching the lawsuit to obtain a court order requiring third-parties (for example blog websites or ISPs) to offer up identifying information about anonymous commenters.  This was the case in a recent decision of the Nova Scotia Supreme Court, Mosher v. Coast Publishing Ltd., where Google and the publishers of a local newspaper were ordered to provide personal information about anonymous posters who allegedly defamed the local fire department.

Voluntary Disclosure
A court order is not the only way to unmask anonymous internet commenters.  Unless they are contractually bound not to, website authors and administrators may voluntarily disclose personal or identifying information about an anonymous poster.  They may be especially motivated to do so when faced with a lawsuit.  For example, in a settlement between now defunct and AdviceScene, " agreed to disclose and provide with the Internet Protocol (IP) and email addresses of four anonymous forum members. These users are alleged to have posted defamatory statements directed against"

So what is the anonymous commenter to do?  Aside from educating yourself about what qualifies as libel (a good resource is here), I suggest asking yourself whether you would still press 'enter' if your mother, your colleague or even your boss would be sent a copy of your comment?  Imagining you aren't anonymous acknowledges the reality that anonymity may no longer exist on the internet.

Is There a Constitutional Right to Legal Aid?

Madam Justice Newbury of the B.C. Court of Appeal once wrote that in a constitutional law context, access to justice consists of, “reasonable and effective access to courts of law and the opportunity to obtain legal services from qualified professionals, that are related to the determination and interpretation of legal rights and obligations by courts of law or other independent tribunals.”[1]

The decline in government funding for legal aid has made Justice Newbury's twin criteria, that is reasonable access to the courts and the ability to obtain legal services, increasingly elusive.  

Legal aid cuts have also renewed interest in the academic and legal community about the existence of a constitutional right to access to justice.  Legal scholars generally agree that the constitution offers no such explicit right, noting that the oft-cited right to legal counsel in criminal cases does not actually require the government to pay the accused’s legal fees.[2]  

Courts have, however, found that the common law, the constitution and the principle of the rule of law do mandate a right to legal aid in some circumstances.[3]  For example, this right exists in some criminal cases where there is a possibility of a jail sentence and in civil cases involving government-initiated challenges to child custody.[4]

Despite the courts’ reluctance to find an overarching constitutional right to access to justice, some legal experts are hopeful that the courts’ refusal to rule out such a right combined with helpful statements in some access to justice decisions might someday pave the way for the judiciary to increase the scope of the government’s obligation to provide legal aid.[5]  

Much of this hope derives from an SCC decision dating back to 1988 where the court stated, “[w]e have no doubt that the right to access to the courts is under the rule of law one of the foundational pillars protecting the rights and freedoms of our citizens.”[6]  However, the SCC has since rejected the argument that that the rule of law entails an overarching right to legal aid, while leaving the door open to the possibility that certain situations may require the government to provide legal assistance.[7]

At the forefront of the movement to establish a judicially-imposed right to legal aid is the Canadian Bar Association (“CBA”), which commissioned legal opinions from leading access to justice lawyers and professors on the issue.[8]  Unfortunately, a subsequent test case on the constitutional right to access to justice was dismissed for lack of standing at the pre-trial stage by the B.C. Supreme Court .  The B.C. Court of Appeal upheld the dismissal and the SCC did not grant leave to appeal.[9]  

It remains to be seen whether the test case can be reconfigured to remedy the standing problems which led to its dismissal.  Until then, the scope of the right to legal aid remains unresolved.  However, it is clear that measured against Madam Justice Newbury’s two criteria, the ability to use the courts and obtain legal services from qualified professionals, access to justice remains widely unavailable in Canada.

How to Make Small Claims Court Cheaper

The Community Legal Assistance Society has published a new guide called "Waiving Filing Fees in BC Small Claims Court" which offers step-by-step advice on how to apply to the court for an order which allows parties to avoid these fees.

Although Small Claims Court is designed to be more accessible and less expensive than the B.C. Supreme Court, the filing fees can still be prohibitive for low-income parties.  For example, the fee for filing a claim ranges from $100-$156 depending on the amount of money at stake, while defendants must pay $26-50 to file a reply.  A complete list of filing fees can be found here.

It is also possible to apply to have court fees waived at the B.C. Supreme Court by applying for indigent status, which I wrote about here.

Paralegals Offer Free Help With Legal Documents

Volunteer paralegals in British Columbia are offering free help with drafting legal documents, including court forms, for people representing themselves in civil litigation matters (note that family law issues are excluded).  The paralegals assist clients in hour-long appointments under the supervision of volunteer duty counsel lawyers.  The Amici Curiae Pro Bono Paralegal Program is a partnership between the Law Courts Centre, Access Pro Bono BC and the Vancouver Justice Access Centre.

The pilot program runs every Tuesday evening from 6 to 8 pm at the Vancouver Justice Access Centre at 800 Hornby Street in Vancouver.  Those interested in a getting assistance with preparing legal documents can make an appointment by calling 604 660-2084.

Why We Just Won't Fund Legal Aid

The Public Commission on Legal Aid in British Columbia, which I wrote about here, has issued its final report, called Foundations For Change.  In the report, Commissioner Len Doust, Q.C. makes seven key findings:

  • The legal aid system is failing needy individuals and families, the justice system, and our communities.
  • Legal information is not an adequate substitute for legal assistance and representation.
  • Timing of accessing legal aid is key.
  • There is a broad consensus concerning the need for innovative, client-focused legal aid services.
  • Steps must be taken to meet legal aid needs in rural communities.
  • More people should be eligible for legal aid.
  • Legal aid should be fully funded as an essential public service.
Few of these findings will be news to anyone who has experience with the legal aid system in BC.  However, the report also makes several damning statements about the current state of the legal aid system:

"While the social costs of the lack of legal aid in essential matters are difficult to measure precisely, a clogged, inaccessible system of justice necessarily results in unfair and arbitrary outcomes, often accompanied by human tragedy, and breeds contempt for the justice system and the rule of law."

"Furthermore, no other province or territory in Canada, other than British Columbia, has made such drastic reductions to its legal aid budget while coping with the same fiscal environment. In fact, Ontario has managed to increase its contribution to legal aid during the same lean economic years."

report has been criticized for focusing too much on anecdotal evidence and too little on practical solutions.  However, as my grandmother used to say, you can't make a silk purse out of a sow's ear.  What the legal aid system needs, not just in British Columbia, but across the country, is an injection of cold, hard cash.  By Doust's estimate, B.C. alone needs an additional $47 million to meet the basic needs of low-income residents.  The Legal Services Society's (LSS) budget is currently just $80 million.

The problem is one of perception and priorities.  The public perceives legal aid clients as unsympathetic criminals undeserving of help.  In turn, the public and their chosen politicians prioritize the need for legal aid below other social programs such as education and health care.  While legal aid supporters frequently lament its inadequate funding (and I'm no exception), the truth is that funding would increase if the public considered it a significant priority.

Of course, the public's perception of those who need access to legal aid is deeply flawed.  Set aside for the moment the merits of defending those accused of serious criminal offences (and in my view there are many).  The system's failing is more accurately captured by those it turns away.  As a volunteer, I took on some of the cases which were not covered by the LSS's stringent eligibility requirements, typically those involving low-income housing, first-time offenders, employment problems and family law issues.  

In my view, one of the most gaping holes in the legal aid system is the lack of support for family law cases involving children.  Many of the pro bono cases I handled involved obtaining child support orders for mothers who were, without exaggeration, struggling to house and feed their children.  The organizations I worked with were unable to match even a fraction of these cases with volunteer lawyers.

From a financial, social policy or moral perspective, it makes no sense to me that these situations are excluded from legal aid coverage.  From a purely fiscal standpoint, it stands to reason that a modest investment of legal aid funding in this area would save the government exponentially more dollars in health care, education, welfare and other social costs resulting from thrusting children into poverty.

Like so many other public policy issues, legal aid reform depends on us prioritizing the short term cost of doing the right thing over the debilitating longterm cost of doing the wrong thing.

Get Rid of Unwanted Solicitation in Five Minutes or Less

The advertising kind, I mean.  Advertising invades every nook and cranny of our existence, but you can draw the line at your doorstep with three tips which take five minutes and don't even require you to leave home.
1. Reduce telemarketing calls:  Get your name on the National Do Not Call List by entering your phone number online here.  It takes less than 30 seconds.  There are exceptions, but most telemarketers are prohibited from calling those on the list, or else face stiff fines from the CRTC.

2. Cut out junk mail:  Canada Post will not deliver unaddressed junk mail to homes which place a sign inside their mailbox saying "no junk mail", "no flyers" or something along those lines.  Unfortunately, Canada Post is still obliged to deliver addressed junk mail.  However, you can register online with the Canadian Marketing Association's Do Not Contact List (again, it takes about 30 seconds) and CMA members will stop sending you their junk.

3. Get rid of bulky phonebooks:  Who needs them when a phone number is just a click away?  Save a tree or two and a trip to the recycling bin by opting out of phone book delivery, again through a handy online form from the Yellow Pages Group.  

While these tips won't completely banish all unwanted advertising, they should significantly reduce the amount which finds its way into your home.  Not bad for five minutes, right?
